• Service refers to the Website or Mobile application on Android and IOS platforms.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed or made available by the Service.
• Website refers to iDelivery.
• App refers to iDelivery, accessible from Android & IOS platforms.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company.

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. Termination from the customer end for subscription will be completely non-refundable once paid. Any dispute of service must be resolved with vendor or local shop as we are just a service provider for the vendor.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, even if advised of the possibility of such damages.

We will not be liable for any monetary loss as we are serving as a software service provider to our B2B vendors for products listed on our platform. In case of disputes, you will have to contact the shop or vendor directly.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" without warranty of any kind. The Company makes no representations or warranties regarding reliability, availability, or suitability of the Service for any purpose.

Governing Law

The laws of India, excluding its conflict of law rules, shall govern this Terms and Your use of the Service. All disputes are subject to the jurisdiction of Surat, Gujarat, India.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company. iDelivery will assist you in contacting the local vendor but holds no liability for product quality or service disputes.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be interpreted to achieve the objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Other Service or Product Related Issues

As we don’t have any product of our own, we are not liable for product quality or side effects. You must contact the vendor directly for such matters. iDelivery acts only as a facilitator between you and local shops.

Changes to These Terms and Conditions

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide prior notice. Continued use of the Service after changes means you accept the new Terms.

Delivery Timing and Prices

Delivery timing and pricing can vary depending on your area and provider. You agree to follow the company's timing and pricing policies.

Auto Payment and Wallet

We have an auto payment module that automatically refills your wallet when it reaches a threshold. Once credited, wallet funds are non-refundable. Renewal is required every 364 days due to RBI guidelines.

Cancellation Policy

Subscription: Delivery or service charges are non-refundable once paid, as they represent services already rendered.

Orders: Orders cannot be cancelled after the cut-off time. Refunds or credits are handled by your local vendor in case of non-delivery.
